That statement, in reality, is a half truth.... it would appear that Sarbir may well have sported a less than favourable history given that we had been advised by our legal team to have Tim Sargeant's name added to the contract..... not that it did us any good.
During the years 2002/2003 when Sarbir evolved into City & Country the company specialised in Barn Conversions more so than general building which at that time was just coming into it's own. C&C were certainly not involved in anything resembling the works that are undertaken today, we dealt with what appeared to be little more than a back street builder who turned their hands to converting Barns....
So the question has to be why would they renege on the contract with ourselves to convert the 2 barns concerned when they had obtained the planning consent required to enact the purchase of our property and put the deal in motion. The contract was specifically built around the planning consent being obtained for 2 residential dwellings which enacted the purchase of our property and set the wheels in motion for the Overage payment to ourselves which begs the question why didn't they convert the barns, why did they sell them on... what was the motive if it wasn't all part of an underhand plan to enable City & Country to be able to off load a pair of redundant barns that having already been turned down on planning for conversion had been described as having absolutely "No Commercial Value"..... they had the expertise to carry out the works and they had the contacts required to undertake the works.... so what happened in between.
Tim Sargeant claimed that he required planning approval for more than 2 barns, but that is not what he had agreed in the contract, he was reneging on the contract, but that didn't stop him from completing the purchase and buying our party wall building thereby taking our business from us, why would he do that if he had got what he sought planning consent for which was exactly what he got.... planning for 2 dwellings.
Why didn't he simply seek agreement to allow him to walk away, he got what he asked for.... planning consent for 2 dwellings?
Both of the barns had been sold to private individuals who had never undertaken such works..... they were to all intents and purposes novices having never undertaken such works and yet both of the Barn Conversions were successful and everyone earned good money.
So why would C&C, a specialist in Barn conversions, walk away from a pair of very lucrative simple conversion and renege on the contract with ourselves, complete novices made it work, they were successful..... why would they do that other than for it to have enabled the company to obtain a means of offloading a pair of barns with no commercial value by purchasing our party wall building.
